Game Rag Writer Sues Activision Over Inclusion of Dragonforce In Guitar Hero III

Nathan Smart, head writer for The Game Rag, is suing Activition for the inclusion of Through the Fire and Flames, a song by Dragonforce, in Guitar Hero III.

"I've seen the videos on YouTube," said Smart. "I just don't see me being able to beat this song on Expert and that's just not fair to me, a Guitar Hero loyalist."

The song is one of the hardest songs ever to be included in the Guitar Hero series. Activision said they included the song because they want to make sure that players will continually be challenged as they release new versions of the game. Dragonforce was a natural choice.

"We had Buckethead in [Guitar Hero] Two," said Marl Yernoff, PR for Activision. "It's only natural that we went with another studio band and Dragonforce is the studio-est of them all."

Yernoff is not worried about the suit.

"I don't think there's a court in this nation that would allow a suit like this to go through. I'm not even really sure what we're being sued for. It's a guy that worried that he can't beat our game? What kind of crap is that?"

Smart seems to think otherwise.

"I can't even count the amount of laws they are breaking with Guitar Hero III so I won't. I won't even bother with 'legalese' like 'negligence' or 'tort' or 'reform' or 'lawyer.' Let's just say they made me 'mad.'"

The biggest issue it seems is with Smart's history with the series. He says he's been able to overcome the challenges with the first few games. He just wants to make sure his rep is intact.

"I have been able to beat the Expert setting on all of the Guitar Hero games so far," said Smart. "Well, except for Play With Me, and if I don't beat that one soon, Activision will have another suit on their hands."
